In order to maintain the rights of employees when an employer transfers its business to another employer, TUPE, which is short for Transfer of Undertakings (Protection of Employment) Regulations 2006 must be adhered to.

Key points about TUPE:

Employee rights: Upon transfer of a business or part of a business to a new owner, the employees shall be transferred to the new owner as a matter of law. Their contracts of employment, including terms and conditions, remain the same.

Continuity of employment: Employees are treated as if their employment with the old employer has continued with the new employer, meaning there is no break in their service.

Consultation: Consultations between employer and current employee and predecessor employee representatives is important in informing the workforce about the transfer process, including reasons thereof and any significant measures that affect them.

Dismissal protections: Employees cannot be dismissed because of the transfer itself. If they are, the dismissal is automatically unfair unless there is an economic, technical or organisational (ETO) reason for it.

Changes to employment terms: Any changes to employees’ terms and conditions because of the transfer are usually void, unless they are made for an ETO reason.

In 2017, we launched the Emotie app – a dynamic tool that helps employees better understand, manage and express their emotions in the workplace.

We live in an increasingly fast-paced world, so emotional well-being is more important than ever. And while employment surveys can be effective, they take time to put together and carry out.

In contrast, Emotie works in real time, providing users with a simple yet powerful way to communicate how they feel at work. After all, while businesses are often very good at asking their people how they’re achieving their objectives, they’re not as good at asking how they feel about achieving those objectives.

In fact, when our founder Claire worked for B&Q as Internal Communication and Engagement Manager back in the early 2000s, she understood the value of effective communication through employee surveys, helping to raise B&Q’s Gallup Employee Engagement Survey score from 3.6 to 4.8, achieving the best score in the whole of the Gallup at that time.

Emotie is essential for organisations of five employees or more, and it enables continuous dialogues between employees and managers – even if they are remote or hybrid workers.

How does it work?
